JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-01-2017 The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 22.06.2016 passed in Cr. Misc. No.16549 of 2016 on the ground that the petitioner is suffering in custody since 07.08.2015 and she has got a child of one year who is also languishing in custody. Other co-accused has been allowed bail by this court by the same order. There is no progress in the trial and in near future, the trial is not likely to be concluded and as such, the petitioner deserves sympathetic consideration to which the learned A.P.P. opposes by submitting that victim girl has stated the name of the petitioner regarding her involvement in the crime.
In the facts and circumstances stated above, at present, I am not inclined to reconsider the prayer of bail of the petitioner
Patna High Court Cr.Misc. No.55265 of 2016 (2) dt.11-01-2017 and accordingly, her prayer of bail again stands rejected. However, considering the detention of the petitioner, the learned trial Judge is directed to expedite the trial and to conclude the same preferably within six months failing which, if the petitioner at no fault, may renew her prayer for bail.
