The petitioner seeks bail in a case instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) Bihar Wine Excise Prohibition Act, 2016. It has been submitted on behalf of the petitioner that there is no recovery of any illicit liquor from the possession of the petitioner. The seizure list is part of F.I.R. from which it appears that seizure has been made from the road. The written report itself shows that chowkidar has disclosed the name of the petitioner as one of the accused, who fled away leaving the aforesaid liquor. The petitioner is in custody since 24.08.2018. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.64166 of 2018 (2) dt.25-10-2018 2/2 the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Harlakhi P.S. Case No. 106 of 2017 corresponding to G.R. No.167 of 2017.
