JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 366(A), 120B/34 of the Indian Penal Code.

Petitioner is in jail custody since 13.07.2016 and investigation against him has already been completed. Although, the claim of the prosecution is that petitioner also participated in kidnapping of victim but admittedly, the victim has not been recovered from possession of the petitioner. Moreover, it is informed on behalf of the petitioner that victim eloped with coaccused, Pintu Kumar Pandey and both are still traceless. Considering the aforesaid facts and circumstances as

No.47204 of 2016 (3) dt.09-12-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Muffasil P.S. Case No. 234 of 2014.
