This application is for grant of regular bail in connection with Bahadurganj P.S.Case No.285 of 2018 for the offences under Sections 304(B)/34 of the Indian Penal Code. Prosecution story is that there was altercation between the petitioner and the deceased, petitioner happens to be husband of the deceased, with respect to demand of dowry and later on he received information that her daughter has been killed and she alleged that petitioner and his first wife have killed by hanging the deceased.

Submission of the learned counsel for the petitioner is that she has committed suicide by hanging herself and the petitioner has falsely been implicated in this case. He is in custody since 3.10.2018.

Patna High Court CR. MISC. No.19231 of 2019(3) dt.21-05-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the witnesses have also supported the allegation of demand and the death is due to asphyxia as a result of hanging.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

With the above direction, this application is dismissed.
