This application is filed for grant of regular bail in connection with Bhagalpur Rail P.S. Case No. 103 of 2022 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2018.

The prosecution story in short is that there is recovery of two mobile phones and two blades and on being asked by police force, accused tried to flee. The petitioner is in custody since 16.11.2022.

Learned A.P.P. has vehemently opposed the prayer for

Patna High Court CR. MISC. No.21674 of 2023(2) dt.22-05-2023 2/2 bail.

Considering the period of custody and the allegations levelled against the petitioner, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Railway Bhagalpur in connection with Bhagalpur Rail P.S. Case No. 103 of 2022.

The petitioner will visit the Mozahidpur police station on the every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
