This application for grant of regular bail arises out of Excise Case No.61 of 2020 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

From the prosecution report, it transpires that from the petitioner's hut, the excise officials recovered 494.49 liters of illicit country made liquor.

Learned counsel for the petitioner has submitted that the petitioner has no criminal antecedent.

Be that as it may, considering the allegation of recovery of huge quantity of illicit liquor from the petitioner's hut and there is no averment in the application that the hut does not belong to the petitioner, I am not inclined to grant the

Patna High Court CR. MISC. No.18104 of 2020(3) dt.24-06-2020 2/2 petitioner privilege of regular bail.

This application is accordingly rejected.
