This is an application for grant of regular bail for offences punishable under Section 47(a) of the Bihar Excise Amendment Act, 2016.

It has been submitted on behalf of the petitioner that it is very much clear from the F.I.R itself that the recovered liquor does not belong to the petitioner rather the same belongs to the persons namely, Umesh Rai and Ganesh Rai, the petitioner was only importing the said wine and for that he has been in judicial custody since 17.09.2016.

Heard learned A.P.P. also.

Considering the facts and circumstances of the case, nature of offence and the period of custody let the petitioner above

Patna High Court Cr.Misc. No.55497 of 2016 (2) dt.23-12-2016 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Sitamarhi, in connection with Case No. C2/262/16.
