The petitioner apprehends his arrest in connection with Tikapatti P.S. Case no. 129 of 2018 registered under Sections 406, 420 and 409 of the Indian Penal Code. The petitioner who happens to be Chairman of the PACS had to deposit 540 quintals of rice to SFC, Purnea in lieu of the paddy purchased by him but he had deposited only 270 quintals of rice and defalcated 270 quintals of rice worth Rs.6,24,650/-.
Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. The petitioner is quite innocent and has been falsely implicated in this case. As a matter of fact, petitioner has already deposited the aforesaid
Patna High Court Cr.Misc. No.62941 of 2018(2) dt.14-12-2018 2/2 money on three different dates i.e. on 01.08.2018, 02.08.2018 and 03.08.2018 and the aforesaid deposits have been made prior to the lodging of the F.I.R.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1stClass, Purnea in connection with Tikapatti P.S. Case No. 129 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
