The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 420 and 411 of the Indian Penal Code and Sections 3, 4 and 5 of the Bihar Illegal Mines Act.

The truck of the petitioner was carrying stones chips. The driver and truck both were intercepted by the police. Submission of the petitioner is that at Annexure-2 there is valid challan for transportation of the said stone chips. However, the driver could not show the document as he was illiterate person and the FIR has been lodged. Considering the aforesaid facts, let the petitioner,
