Petitioner seeks bail in Runisaidpur P.S. Case No.459 of 2018 instituted for the offence under Section(s) 30, 30(g), 38(1) of Bihar Prohibition and Excise Act. It is alleged that total 86.400 litres foreign liquor was recovered from the dickey of the car.

Counsel for the petitioner submits that petitioner is neither owner nor driver of the car. He was sitting in the car as passenger of the aforesaid car.

Petitioner is said to be in custody since 11.08.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.62660 of 2018 (2) dt.09-10-2018 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Sitamarhi, in connection with Runisaidpur P.S. Case No.459 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
