JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code. Petitioner is not named in the first information report and for the first time, the name of this petitioner came in this case in confessional statement of co-accused, Murari Das @ Murali Das, who has already been granted privilege of bail by this court vide order dated 04.10.2016 passed in Cr. Misc. No. 29878 of 2016. It appears that except the aforesaid confessional statement of co-accused as well as some criminal antecedent, there is nothing against the petitioner, who is languishing in jail custody since 19.07.2016 and up till now, has not been put on Test

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Jamui in connection with Chandramandih P.S. Case No. 16 of 2015.
