The report of the trial court which is dated 23.11.2021, is to the effect that four out of six charge-sheeted witnesses have been examined. Another witness named in the case diary has also been examined. Only two charge-sheeted witnesses remained to be examined.

Learned counsel for the petitioner, however, submits that there may be witnesses on behalf of the defence also.

This Court, in these circumstances, would only observe that since four out of six charge-sheeted witnesses have already been examined, it would only be in the fitness of things
