The petitioner seeks bail in Barahiya P.S. Case No. 128 of 2019, registered for the offence under Section 304(B), 201/34 of the Indian Penal Code.

It is a case of 'Dowry Death'. The petitioner, who happens to be husband of the deceased, is alleged to have committed the murder of daughter of informant for dowry and disposed her dead-body.

It is submitted that petitioner has been falsely implicated in this case. In fact, the deceased has committed suicide due to petty family feud. None of the independent witnesses has supported the prosecution case and petitioner is in custody since 13.05.2019.

However, learned A.P.P. for the State opposed the bail

Patna High Court CR. MISC. No.30316 of 2021(2) dt.17-08-2021 2/2 petition and submitted that petitioner is husband of deceased and deceased has died in an unnatural circumstances within seven years of marriage at her matrimonial house. Considering the nature and gravity of offence and petitioner being husband of the deceased, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
