Petitioner is languishing in custody in connection with Baisee P.S. Case No. 73 of 2016 for the offences punishable under Sections 457/341/323/376/504/34 of the Indian Penal Code. According to F.I.R. the petitioner along with others entered into the house of the informant after breaking the door and initially searched for the daughter of the informant, thereafter tied with rope to another sister of the informant and committed rape with informant. Besides the informant even in statement under Section 164 Cr.P.C. the sister of the informant Saharbano has also supported the allegation.

Submission is that the petitioner is in custody

Patna High Court Cr.Misc. No.53196 of 2016 (3) dt.13-01-2017 2/2 since 18.09.2016 and false implication is there due to village politics.

Considering the statement of the victim, I am not inclined to enlarge the petitioner on bail. The bail prayer of the petitioner is refused. However, the petitioner may renew the prayer for bail if the trial is not concluded within one year from the date of communication of the order. The trial Court is directed to be expedited the trial.
