The petitioners are in custody in connection with Sessions Trial No. 193 of 2000 arising out of K. Nagar (Maranga) P.S. Case No. 156 of 1999, registered for the offence punishable under Sections 323,324,326,447,504 and 307 of the Indian Penal Code.
Learned counsel for the petitioners submits that earlier petitioners were granted bail on merit. He further submits that due to communication gap between the petitioner and Pairvikar no proper Parvi has been made on behalf of the
Patna High Court CR. MISC. No.19729 of 2019(2) dt.01-04-2019 2/2 petitioners as such the bail bonds of the petitioners have been cancelled. He submits that petitioners are in custody since 20.12.2018.
Considering the fact that earlier on merit petitioners were granted bail, the Court is inclined to grant bail to the petitioners with caution that the petitioners have to assist the Court in early disposal of the trial, in the event the petitioners are found absent without any cogent reason, the Court below shall be at liberty to cancell the bond bonds of the petitioner. Let, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 5th Additional Sessions Judge, Purnea in connection with Trial No. 193 of 2000 arising out of K. Nagar (Maranga) P.S. Case No. 156 of 1999.
