The petitioner seeks regular bail in connection with Halsi P.S. Case No. 43 of 2020, registered for the offence punishable under Sections 304(b)/34 of the Indian Penal Code.

The allegation is regarding the accused persons having killed the deceased victim lady on account of non-fulfillment of the demand for dowry.

The learned counsel for the petitioner has submitted that the petitioner is innocent, she has been falsely implicated in the present case,

Patna High Court CR. MISC. No.21561 of 2022(6) dt.18-01-2023 2/3 she is having a clean antecedent and she is languishing in custody since 20.12.2021. It is further submitted that the petitioner is the mother-in-law of the deceased victim lady and in fact, the father-in-law of the deceased victim lady has already been granted bail by a coordinate Bench of this Court, vide order dated 27.7.2021, passed in Criminal Miscellaneous No. 26096 of 2021 on the ground that specific allegation has been levelled against the husband of the deceased victim lady.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials on record as also considering the parity of the case of the petitioner with that of the co-accused person, who has already been granted bail by a coordinate Bench of this Court, I deem it fit and proper to direct for release of the petitioner on

Patna High Court CR. MISC. No.21561 of 2022(6) dt.18-01-2023 3/3 regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Lakhisarai in connection with Halsi P.S. Case No. 43 of 2020.
