Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is in jail custody since 19.12.2019 in connection with Gadhpura P.S. Case No. 145 of 2019 registered for the offences punishable under Sections 414, 420/34 of the Indian Penal Code.

Petitioner and one co-accused Bittu Kumar @ Navneet Kumar were caught by the police while they were going on the stolen motorcycle. In course of investigation, it came to light that the aforesaid motorcycle was stolen from West Bengal.

Patna High Court CR. MISC. No.20457 of 2020(2) dt.27-08-2020 2/2 Petitioner does have criminal antecedents but submission on behalf of the petitioner is that having similar allegation, co-accused Bittu Kumar @ Navneet Kumar has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 3.3.2020 passed in Cr. Misc. No. 15121 of 2020.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Gadhpura P.S. Case No. 145/2019.
