JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 323, 420, 406, 120B, 504/34 of the Indian Penal Code.

The accusation is of executing the sale deed with regard to the land falls in the share of the informant. It is submitted by learned counsel for the petitioner that the informant is the son-in-law of the step-brother of the petitioner and the petitioner transferred her share of land which she brought by virtue of exchange. Moreover, Partition Suit No.278 of 2014, filed by the petitioner is pending wherein the informant is defendant.

Considering the accusation arising out of civil nature of

Patna High Court Cr.Misc. No.37609 of 2015 (2) dt.17-09-2015 2/2 dispute, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sadar, Motihari, East Champaran in connection with Motihari Muffasil P.S. Case No.279 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
