Heard both parties.

The petitioner seeks bail in Pachrukhi P.S. Case No. 126 of 2015, registered for the offence punishable under Sections 302, 323 and other allied sections of the Indian Penal Code.

It is submitted on behalf of the petitioner that there is general and omnibus allegation. Though, petitioner is named in the FIR, but co-accused namely, Sanjeet Kumar Yadav, Upendra Singh having similar allegation have already been granted bail by this Hon'ble Court vide order dated 07.12.2015 passed in Cr. Misc. No. 52272 of 2015 and order dated 18.12.2015 passed in Cr. Misc. No. 57175 of 2015. It is a case of accident in between two motorcycles in which one of the co-villagers of petitioner

Patna High Court CR. MISC. No.28749 of 2021(2) dt.10-08-2021 2/2 received injury. Petitioner is having clean antecedent and he is in custody since 11.01.2020. Chargesheet has already been submitted.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Siwan in connection with Pachrukhi P.S. Case No. 126 of 2015, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below. (ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
