The petitioner is languishing in custody since 29.01.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Excise (Amendment) Act, 2016. It is alleged that from an auto rickshaw, 48.960 litres of illicit Indian Made Foreign Liquor were recovered. It is submitted by learned counsel for the petitioner that the auto rickshaw was being driven by the co-accused, Md. Rahbar and the petitioner is the owner of the alleged auto rickshaw. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the recovery has been made

Considering the nature of recovery and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum- Special Judge, Excise, Purnea in connection with Prosecution Report C-I No. 11 of 2019.
