For restoration of the same, the present criminal miscellaneous has been filed. Opposite Party no. 2 was directed to file affidavit whether she has received the cost amount. In the counter affidavit she has stated that she has received the money-order of the cost amount on 30.08.2017. The reason for non-appearance is explained in the petition and the same is ordered to be restored after setting aside the dismissal order.
