====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Prosecution Case C-1 No.343 of 2018 registered under Section 30(a) of the Bihar Excise (Amendment) Act, 2016. The accusation is of recovery of 41.835 liters Indian Made Foreign Liquor, kept in different bottles, from a tempo in which the petitioner was also found sitting.

Learned counsel appearing on behalf of the petitioner submits that the petitioner was going to her destination boarding on tempo but, on mere suspicion, she was apprehended by the police. The petitioner is not the driver of the tempo. The

Patna High Court Cr.Misc. No.62318 of 2018(2) dt.06-10-2018 2/2 petitioner having no criminal antecedent is in custody since 06.09.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Purnea, in connection with Prosecution Case C-1 No.343 of 2018.
