Petitioner seeks bail in Choutham P.S. Case No. 153/18 registered for the offence under Sections 25 (1-B)a/26 of the Arms Act.
Allegation against the petitioner is of recovery of a country made pistol and an empty cartridge from his garage. Submission on behalf of the learned counsel for the petitioner is that it is open place and nothing has been recovered from his possession. He is in custody since 01.08.2018. There is no independent witness also. He has no criminal antecedent. Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, stated above, I am not inclined to grant
Patna High Court Cr.Misc. No.64299 of 2018 (2) dt.26-10-2018 2/2 bail to the petitioner at this stage. However, once charge is framed against him or he completes six months in custody, he may renew his prayer for bail.
The application is, accordingly, dismissed.
