Atleast for two reasons, this Court would decline to entertain the application. Firstly, the aggrieved person i.e. the purchaser of the subject land is not the writ petitioner, and secondly, the application has been filed to direct the respondent no. 5 to hand over possession of the subject land which was purchased by the husband of the petitioner.

I am afraid, a writ can not be issued commanding the respondent no. 5 to hand over possession of the subject land.

Patna High Court CWJC No.2185 of 2015 (2) dt.03-02-2015 The application is dismissed. Dismissal of the application shall, however, not preclude the aggrieved party from approaching the appropriate authority/forum for redressal of the grievance as raised in this application.
