The petitioner seeks bail in Sugauli P.S. Case No. 162/2018, instituted for the offences under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code read with Section 27 of Arms Act.
Learned counsel for the petitioner has submitted that altercation has taken place due to not inviting the petitioner in marriage.
It is alleged in the written report that on the date of occurrence due to aforesaid altercation, this petitioner caused firearm injury to the son of informant.
Learned counsel for the petitioner has submitted that there is no mention in the F.I.R. that on which part of body of the
Patna High Court Cr.Misc. No.64089 of 2018 (2) dt.25-10-2018 2/2 son of informant injury was caused.
Learned Sessions Judge has mentioned that no injury report is available in case diary.
Supplementary affidavit has been filed enclosing therewith injury report of the son of informant wherein doctor has found the injuries to be simple in nature.
Petitioner is in custody since 21.05.2018.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Sugauli P.S. Case No. 162/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
