This application, filed on behalf of the petitioner, under Section 482 of the Code of Criminal Procedure, is directed against the order dated 02.07.2012 passed in Complaint Case No.229/12/Tr.No.74/12 by the court of Sri M.K. Srivastava, J.M.1st class, Madhubani, summoning the accused including the petitioner, on inquiry under Section 202 of the Code of Criminal Procedure, finding prima facie case under Sections 384 and 406 of the Indian Penal Code against the petitioner. On going through the impugned order, I find no illegality therein amounting to abuse of the process of the court for

Patna High Court Cr.Misc. No.15646 of 2013 (3) dt.13-02-2017 2/2 interference with the same in an extraordinary jurisdiction under Section 482 of the Code of the Criminal Procedure of this Court. Accordingly, this application stands dismissed. However, the petitioner would be at liberty to raise his points, as raised herein, in the trial court at the appropriate stage.
