The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 353, 504, 506, 427 of the Indian Penal Code and section 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The prosecution case as per the written report of the informant informant, Pramod Kumar Dutta, Head Clerk of D.T.O. Office, Aurangabad is to the effect that the petitioner came to the office of D.T.O. and abused the D.T.O. by calling caste name since the D.T.O. seized the bus of the petitioner being defaulter in payment of road tax.

No.37697 of 2015 (2) dt.17-09-2015 2/2 It is submitted by learned senior counsel for the petitioner that admittedly the D.T.O. was not present in the office at the time of occurrence and for the occurrence of 19.06.2015 the FIR was registered on 25.06.2015 whereas the petitioner filed Complaint Case No. 572 of 2015 on 22.06.2015 for the occurrence of 16.06.2015 against the D.T.O., Aurangabad.

Considering the delayed lodging of the case and the case lodged by the petitioner at earlier point of time, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S. Case No. 266 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
