APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 13-05-2020 Heard Mr. Sanjay Kumar @ S.K., learned counsel for the petitioner and learned counsel appearing for the State through video conferencing.

The petitioner seeks regular bail in connection with Saraiya (Jaitpur O.P.) P.S. Case No. 661 of 2019 registered for the offence punishable under Section 272/273 of the I.P.C. and under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioner is that Police got a secret information that petitioner along with co-accused Sanjay Chaudhary has brought the consignment of liquor through a Pick-UP Van and proceeded towards the place of occurrence and recovered a total quantity of 762.3 liters of

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case inasmuch as no illicit liquor has been recovered from the conscious possession of the petitioner and from perusal of the seizure list it would be evident that illicit liquor has been recovered from the road side. Learned counsel for the petitioner further submits that similarly situated co- accused Sanjay Chaudhary has been granted bail by this court in Cr. Misc. No. 85555 of 2019 .

Having heard learned counsel for the parties and taking into consideration the fact that similarly situated co -accused has been granted bail by this Court and no illicit liquor has been recovered from the conscious possession of the petitioner, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Spl. Judge, Excise Act, Muzaffarpur in connection with Saraiya (Jaitpur O.P.) P.S. Case No. 661 of 2019 if the petitioner is not required in other case.

It is made clear that at the time of furnishing bail bond
