JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-04-2024 The present writ petition has been filed seeking the following relief:- "(i). For giving specific directions and instructions to the respondents (specially Respondent No. 1), so that the representations of the petitioners (AnnexureP2), which relates to their

Patna High Court CWJC No.5366 of 2024(2) dt.25-04-2024 2/3 termination/dismissal from the service of Data Entry Operators, in the Primary Health Centers of Chehra Kala, Patepur and Goraul, are decided and settled at the earliest.

(ii) For issuance of writ in the nature of Mandamus, so that the respondents are commanded to forthwith allow the petitioners to work as Data Entry Operators in the aforesaid primary health centers of Chehra Kala, Patepur and Goraul, in view of the fact that now it is not necessary for the Data Entry Operators, working with the Health Societies to get themselves registered with the private company, which is Urmila International.

(iii) For instructing the respondents so as to explain the circumstances which have influenced them from giving preferential treatment to some of the Data Entry Operators, as they after dismissal were not only absorbed in the same post, but proper salary heads were also created and defined for them.

(iv) For seeking explanation from the respondents as to why no proper chance of Notice and Hearing was given to the petitioners, while they were dismissed from their services of Data Entry Operators."

After some arguments, the learned

Patna High Court CWJC No.5366 of 2024(2) dt.25-04-2024 3/3 counsel for the petitioners seeks liberty on behalf of the petitioners to approach the respondent no.04, i.e. the Civil Surgeon-cum-Member Health Secretary, Vaishali for redressal of their aforesaid grievances. Liberty, so sought, is granted.

Accordingly, the writ petition stands disposed of.
