JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-06-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Dighwara P.S. Case No. 21 of 2021, registered for the offences punishable under Sections 341, 323, 498A, 504/34 of the Indian Penal Code read with Section 3& 4 of Dowry Prohibition Act.

Both the parties have compromised the case. A xerox copy of compromise petition dated 29.01.2022 duly signed by the petitioner and opposite party No. 2 is annexed with the record. The parties were on the terms and conditions that the petitioner shall pay Rs. 7, 50,000/- as one time settlement to Puja Kumari (O.P. No. 2). Out of that amount an A/c payee cheque of Rs. 4,00,000/- was handed over to Puja Kumari on 29.01.2022 and the rest amount of Rs. 3,50,000/- was also paid to the opposite party No. 2, as submitted by both the parties. Nothing remains to be paid.

Learned counsel for the parties have submitted that altogether four cases are pending between the parties and they are ready to withdraw Divorce Case No. 42/2021 and they shall file a petition for divorce under Section 13 (B) of the Hindu Marriage Act on the basis of mutual consent. They shall also withdraw Maintenance Case No. 69 of 2021, Complaint Case No. 406 of 2021 and Dighwara P.S. Case No. 21 of 2021. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs.

No.28676 of 2021(7) dt.22-06-2022 3/3 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IX, Saran at Chapra in connection with Dighwara P.S. Case No. 21 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
