JUSTICE SUDHIR SINGH ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 324, 354, 379, 504, 506/34 and 307 of the I.P.C.
Allegation against the petitioner is that he assaulted the informant by sword at his head causing injuries. It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.10.2015. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The alleged occurrence is said to have taken place on 11.9.2015, whereas the F.I.R. was instituted on 15.9.2015. Delay has not been explained by the prosecution.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Assistant Sessions Judge 1st, Madhepura in connection with S.T.
