The petitioners seek anticipatory bail in a case instituted for the offence under Sections 353/34 of the Indian Penal Code.

It has been submitted that there is general and omnibus allegation against the petitioners.

In the written report it is alleged that while the informant along with the lady constable and abducted girl Madhu Kumari were going to Motihari Sadar Hospital, for medical examination of Madhu Kumari, the petitioners tried to take

Patna High Court Cr.Misc. No.3150 of 2017 (2) dt.02-02-2017 2/2 possession of the girl for which they committed scuffle with them. They were bent upon to kill Madhu Kumari. From the written report it also appears that no injury has been caused to anybody. Considering the facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Motihari Town P.S. Case No. 625 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
