Petitioner seeks bail in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. He is in custody since 29.01.2018. Earlier prayer for bail was refused on 03.05.2018. The impugned order reveals that charges were framed on 04.01.2019 and no prosecution witness has been examined.

Considering the period already undergone by the petitioner and undertaking of the petitioner that he will fully cooperate with the trial, let the petitioner, above named, be

No.22528 of 2019(2) dt.09-04-2019 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Patory (Mohanpur O.P.) Police Station Case No. 37 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

If the trial would hamper due to non-cooperation of the petitioner, the court below shall be at liberty to cancel the bail bond of the petitioner.
