The petitioner, being the husband of the victim, seeks bail in connection with Sakra P.S. Case No.216 of 2018 registered for the offence punishable under Section 304B and other allied Sections of the I.P.C., which is pending in the court of learned Sub-Judge-XIII Cum A.C.J.M.-4th, Muzaffarpur.

It is submitted by the petitioner's counsel that the victim has died on account of prolonged illness. The learned APP appearing on behalf of the State submits that the forensic report has been received. The same corroborates poisoning, leading to the death of the victim. The petitioner, being the husband, would be primarily

The death being in the matrimonial home, the presumption also under the relevant Section arises against the petitioner. This Court would find that the petitioner is in custody since 27.05.2018.

In the circumstances, interest of justice demands that the trial court should proceed to conclude the trial expeditiously and without any undue delay.

The application is dismissed.
