Petitioner is accused in connection with S. Tr. No. / arising out of Bihar P.S. Case No. 61 of 2016 registered under Sections 307 and other allied sections of the I.P.C. to which section 302 was added later on and section 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that petitioner is not named in the FIR. In restatement also, petitioner name has not been taken. His name came after forty days of the alleged occurrence. Petitioner is separate from Vikky Yadav in mess and property. Petitioner has no criminal antecedent and is in custody since 08.08.2016.

No.53713 of 2016 (4) dt.16-02-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Bihar P.S. Case No. 61 of 2016.
