Petitioners apprehend arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

There was recovery of fifty five litres of country made liquor and two motrocycles were seized from the place. Learned counsel appearing for the petitioners submits that the petitioner is innocent and has falsely been implicated in this case due to village politics. No incriminating material has been recovered from the conscious possession of the petitioners and they are no way connected with the aforesaid recovery.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-2, Nawada in connection with Kawakole Police Station Case No 339 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
