2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 304B of the Indian Penal Code, registered in connection with Motipur P.S. Case No. 79 of 2020.
3. As per prosecution case, the allegation against the petitioner along with others is of killing the sister of the informant due to non-fulfillment of dowry demand.
4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. Petitioner is the husband of the deceased. There is no specific overt act alleged against the petitioner. He
Patna High Court CR. MISC. No.24854 of 2024(3) dt.25-07-2024 2/2 submitted that from perusal of the statements of the independent witnesses, it appears that the deceased herself committed suicide by pouring kerosene oil upon her as her husband (petitioner) did not give a new Saree on the occasion of Chhat, which has come vide paras- 36, 37 and 38 of the case diary. Petitioner is a person of clean antecedent and he is in custody since 28.10.2022.
5. Learned APP for the State has opposed the prayer of bail.
6. Considering the above facts and circumstances of the case as well as period of custody, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-2nd (West), Muzaffarpur in connection with Motipur P.S. Case No. 79 of 2020, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
