The petitioner apprehends his arrest in Jehanabad P.S. Case No. 183/2016, registered for the offences punishable under Section 7 of the Essential Commodity Act. The petitioner is the owner of an auto-rickshaw bearing Registration No. BR 01PA 9593. Sunil Chaudhary, the driver of the auto-rickshaw was apprehended and from his autorickshaw LPG cylinder was recovered. Learned counsel for the petitioner submits that he entrusted his auto-rickshaw to the driver to ply on road on hire and he had no knowledge about using of LPG cylinder in the autorickshaw. The driver has already been enlarged on bail vide order dated 31.05.2016 passed in Cr. Misc. No. 23934/2016.

No.8646 of 2017 (3) dt.08-03-2017 2/2 Considering the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 183/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
