The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 and 414 of the Indian Penal Code.
The prosecution case is that one ox and a she-buffalo of the informant were stolen. Subsequently, stolen ox was recovered from the animal's shade of the petitioner. It is submitted by learned counsel for the petitioner that the alleged recovered ox was purchased by the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Patna High Court Cr.Misc. No.37784 of 2015 (2) dt.21-09-2015 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sour Bazar P.S. Case No.106 of 2015, pending before the learned Judicial Magistrate, 1st Class, Saharsa.
With the above observation, this application is, accordingly, disposed off.
