The petitioner is apprehending arrest in a case registered for the offences punishable under sections 363 and 366A/34 of the Indian Penal Code.

The prosecution case is of kidnapping the minor daughter of the informant. In 164 Cr.P.C. statement the victim has alleged that co accused Sanjay, this petitioner and three unknown kidnapped her though she was ravished by co accused Sanjay Paswan.

It is submitted by the learned counsel for the petitioner that the petitioner has been roped in the present case since he happens to be the brother of Sanjay Paswan. Statement

Patna High Court Cr.Misc. No.38311 of 2015 (2) dt.24-09-2015 2/2 has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that the informant retracted from the initial version and has filed a petition to that effect before the learned court below.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Bibhutipur P.S. Case No. 25 of 2015 pending in the court of learned JM Ist Class, Rosera. This application is disposed of with the aforesaid observation/direction.
