The petitioner seeks bail in Ahiyapur P.S. Case No.1408 of 2019 registered under Sections 20 and 22 of the N.D.P.S. Act.

The informant alleged that on chase, ten persons including the petitioner were apprehended and on search, 100 gms. of charas was recovered.

The learned counsel for the petitioner submits that from perusal of the seizure list, it would appear that from the possession of Md. Moti, Deepak Pandit and Suraj Kumar(the petitioner), 100 gms. of charas was recovered but the informant did not specify the amount of recovery of charas from the

Patna High Court CR. MISC. No.19999 of 2020(2) dt.02-07-2020 2/2 exclusive possession of the petitioner. Similarly situated coaccused persons namely, Sanjay Kumar Rai, Md. Moti, Deepak Pandit @ Deepak Kumar and others have been granted bail by different Benches of this Court. Petitioner is in jail since 29.11.2019.

Taking into consideration the facts that what amount of charas was recovered from the possession of the petitioner has not been specifically mentioned in the seizure list and similarly situated other co-accused have already been granted bail by different Benches of this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Muzaffarpur in connection with Ahiyapur P.S. Case No.1408 of 2019.
