JUSTICE BIRENDRA KUMAR ORAL ORDER 06-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 153, 153A, 188, 341, 342, 323, 435, 427, 337, 338, 307, 353 and 120(B) of the Indian Penal Code.

Allegation is that the petitioners were identified as members of the group which was bent upon violating the prohibitory order under Section 144 Cr.P.C. and was going to lay foundation of the temple on the disputed land. Further allegation is of obstruction in discharge of the official duty by the policemen

Patna High Court Cr.Misc. No.14598 of 2017 (2) dt.06-04-2017 2/2 and commission of assault with intent to commit murder. Considering the general and omnibus allegation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Darbhanga/Successor Court in connection with Singhwara Police Station Case No. 165 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
