Patna High Court L.P.A No.161 of 2022(5) dt.29-08-2024 2/3 (Per: HONOURABLE THE CHIEF JUSTICE) 29-08-2024 The appellants are concerned with an appointment which was initiated in the year 2006 to the post of Niyojit Teacher. The learned Single Judge found that the appellants' application was in the year 2007 while the last date for submitting application form was August, 2006. Only on that ground the writ petition was dismissed.

2. The learned Counsel for the appellants submits that in fact the application was filed in the year 2006 itself.

3. The learned Counsel for the appellants specifically pointed to Annexure-1, which is a receipt indicating the submission of an application of the first appellant; Tamanna Perween, on 31.08.2006. So far as the second appellant is concerned, the receipt is produced at Annexure-8 which does not show any date.

4. Admittedly, the last date for application was in August,2006 which is also seen from the impugned order in the appeal. However, the date is not specified. Obviously the submission of application of the second appellant is not on a specified date and with respect to the first appellant, it is on 31.08.2006. The appellants had a duty to establish before Court as to the last date of the application, which has not been done. We find absolutely no reason to entertain this appeal with

5. The writ petition is dismissed.
