In this case, the petitioner is challenging the order dated 26.06.2015 passed by learned Additional Sessions JudgeIV, Madhubani, in Sessions Trial No.361 of 2014, arising out of Andharmath P.S. Case No. 23 of 2013, by which the learned Court below has rejected the discharge petition filed by the petitioner.

The prosecution case is that the missing son of the informant was found in the courtyard of the petitioner in an unconscious condition and subsequently, the son of the informant died.

I have perused the impugned order dated 26.06.2015, by which the learned Court below has rejected the

Patna High Court CR. MISC. No.37971 of 2015(2) dt.18-03-2023 2/2 discharge petition filed by the petitioner and found that there is no illegality and infirmity in the aforesaid order since prima facie case is made out against the petitioner. Accordingly, this application is dismissed.
