JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-06-2020 Heard Mr. Pramod Kumar Sinha, learned counsel for the petitioner and Mrs. Meena Singh, learned Additional Public Prosecutor appearing for the State through video conferencing. The petitioner seeks regular bail in connection with Sessions Trial No. 562 of 2019 arising out of Nalanda P.S. Case No. 81 of 2019 registered for the offence punishable under Section 341, 323, 504, 506, 354, 308/34 of the I.P.C. and subsequently Section 302 of the I.P.C. has been added. The allegation against the petitioner as per the First Information Report is that the petitioner assaulted the deceased ( the mother of the informant) by means of lathi, leading to her death.

Learned counsel for the petitioner referring to Annexure - 1 to this bail application submits that the petitioner had moved an application for bail earlier in Cr. Misc. No. 6773 of 2020, which was rejected with liberty to the petitioner to renew her prayer for bail after framing of charge. Learned

Patna High Court CR. MISC. No.18582 of 2020(2) dt.04-06-2020 2/2 counsel referring to Annexure- 4 to the petition submits that charges have been framed against the petitioner by learned Sessions Judge on 17.02.2020. Learned counsel for the petitioner submits that petitioner is in custody since 13.06.2019. Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has renewed her prayer for bail in view of the observation given by this Court, charges have been framed against the petitioner on 17.02.2020 and the petitioner is in custody since 13.06.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs.

25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge, Nalanda at Bihar Sharif in connection with Sessions Trial No. 562 of 2019 arising out of Nalanda P.S. Case No. 81 of 2019. It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
