JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 304B, 201/34, 120B of the Indian Penal Code.

Petitioner happens to be husband of the deceased and there is specific allegation against the petitioner that he used to torture the deceased on account of non fulfilment of illegal demand. The post mortem report of the deceased goes to show that she died of burn injuries. According to prosecution case, the deceased died at her matrimonial home and no information regarding her death was given either to informant or the police. No.37548 of 2016 (3) dt.08-11-2016 2/2 the case as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Kateya P.S. Case No. 199 of 2015 pending in the court of Chief Judicial Magistrate, Gopalganj stands rejected. However, the Chief Judicial Magistrate, Gopalganj is directed to commit the case of the petitioner to the court of Sessions in accordance with law within two weeks from the date of receipt/production of a copy of this order and after commitment, the concerned Sessions court shall expedite the trial of the petitioner and try to conclude the same as early as possible.
