JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 Petitioner prays for bail in connection with Bakhtiyarpur P.S.Case No. 41 of 2018 registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

Allegation is of committing theft of rice from the godown and bags containing rice were found kept in the house of the petitioner and petitioner is not named in the FIR. Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of recovery of some bags and nothing else and he is in custody for five months.

Heard learned APP also, who has opposed the prayer for bail of the petitioner stating that bags were recovered from the house of the petitioner and he is accused in two other cases

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Barh, Patna, in connection with Bakhtiyarpur P.S.Case No. 41 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
