JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

This is an application for grant of regular bail for offences punishable under Sections 47A and 54 of the Bihar Excise Amendment Act, 2016.

It has been submitted on behalf of the petitioner that the petitioner's name surfaced in this case only on the basis of suspicion and there is nothing against the petitioner. So far as recovery of alleged liquor from the car is concerned, the petitioner has nothing to do with the said car or alleged recovery. The petitioner was waiting for bus to come to patna and only when he went on the place of occurrence to enquire about the matter, he was intercepted by the police. The petitioner has been languishing in judicial custody since 27.09.2016.

Having heard both sides. In view of the fact that petitioner's name surfaced in this case only on account of suspicion and there is nothing against the petitioner and he has been in judicial custody since 27.09.2016, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Aurangabad, in connection with Barun P.S. Case No. 151 of 2016.
