JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-07-2019 Petitioner seeks bail in anticipation of her arrest in connection with Town P.S. Case No. 102 of 2004 registered for the offences punishable under Sections 307, 326, 34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is not named in the FIR and there is allegation as per FIR is that while informant was sitting at his darwaja, some miscreants came and fired on him. Later on informant succumbed to the injuries. It further appears that during course of investigation name of the petitioner transpired. Submission of learned counsel for the petitioner is that she has been implicated in this case due to land dispute and except suspicion there is nothing against her.

No.27278 of 2019(4) dt.09-07-2019 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail on the ground that the case is of the year 2004 and it appears that after lodging FIR in this case she fled away with accused persons to Delhi and after 15 years she has filed this application for grant of anticipatory bail. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. Petitioner may surrender and pray for regular bail, which shall be considered on its own merit and, if possible, to be disposed of on the same day.
With the above observation, this application is dismissed.
