The learned counsels are appearing and making submissions from their residence. The Court Master and Secretary are also part of this virtual Court proceedings from their homes, all with the aid of audio visual technology. Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner-Ranju Ram seeks bail in connection with G.R. No.65/2020 arising out of Rajpur P.S. Case No.03/2020 registered for the offence punishable under Sections 363, 307/34 of the Indian Penal Code.

Patna High Court CR. MISC. No.18181 of 2020(3) dt.26-06-2020 2/3 The prosecution case is that the informant's daughter was found in an unconscious state near the Peepal tree. She was thereafter admitted for treatment at Sadar Hospital, Buxar. It is in these circumstances that the F.I.R. has been lodged wherein the informant has alleged that his daughter was taken away by the eight named accused persons, including the petitioner, about six months back.

Petitioner's Counsel submits that the petitioner has no criminal antecedents. The admitted position is that the informant's daughter was taken away six month back. However, neither any report has been lodged nor any complaint made. Referring to paragraph 40 of the case diary, it is submitted that co-accused Sikhu Mushar is the one who has taken away the informant's daughter and there is no role attributed to the petitioner. His bona fide is evident from the fact that he has been arrested from his own house on 08.01.2020. The said statement is based on paragraph 17 of the case diary during the course of investigation.

Learned APP for the State has opposed the prayer for bail by submitting that the petitioner is a named accused. Considering the rival submissions, this Court is inclined to allow the petitioner's prayer for bail.

No.18181 of 2020(3) dt.26-06-2020 3/3 Accordingly, let the petitioner-Ranju Ram be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with G.R. No.65/2020 arising out of Rajpur P.S. Case No.03/2020, subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
